论“一带一路”背景下海峡两岸暨香港、澳门的反洗钱合作

On Anti-Money Laundering Cooperation in the Two Sides of the Taiwan Straits and Hongkong and Macao under the Background of the Belt and Road

海峡两岸暨香港、澳门的稳定、安全与经济繁荣对“一带一路”倡议的推进具有重大意义。当前海峡两岸暨香港、澳门各自的反洗钱法律体系已经初步建立,但是在区际跨境反洗钱合作机制的建设、司法与执法合作方面进展较为缓慢。为有效预防和打击跨境洗钱犯罪,推进反腐败追逃追赃,未来亟待采取以下措施加强海峡两岸暨香港、澳门的反洗钱合作:(1)增强海峡两岸暨香港、澳门反洗钱法律的衔接与协调,减少法律冲突;(2)充实、完善区际反洗钱合作协议;(3)灵活构建海峡两岸暨香港、澳门反洗钱合作机制;(4)加强反洗钱信息交流与共享;(5)全面合作,联合打击“地下钱庄”;(6)加强监管,共同打击互联网支付平台的洗钱犯罪;(7)先行强化海峡两岸暨香港、澳门城市之间的反洗钱合作;(8)在日常经济合作中增强各部门的反洗钱合规意识。

It is highly strategically meaningful for the Two Sides of the Taiwan Straits and Hongkong and Macao to keep stable,secure and economically prosperous in order to further develop the Belt and Road.Currently,while legal system of anti-money laundry around the four regions have been set up,cooperation in establishment of a cross-border anti-money laundering mechanism among the regions,as well as justice and enforcement,is progressing very slowly.With the purpose of preventing and combating trans-regional money laundry along with helping hunt for those who have fled abroad and recover ill-gotten gains,measures to strengthen anti-money laundering cooperation around the four regions should be taken in future as follows:1.promoting convergence and harmony of anti-money laundering laws among the regions to reduce conflicts of laws;2.enriching and complementing regional anti-money laundering agreements;3.building up flexibly a mechanism for cooperating in anti-money laundry among the regions;4.leveling up the exchanging and sharing of anti-money laundering information;5.uniting through full cooperation against underground banks;6.tightening supervision to crack down on money laundry on Internet payment platforms;7.strengthening anti-money laundering cooperation among cities of the four regions in advance;8.raising consciousness of anti-money laundry in daily economic cooperation.
