论网络侮辱行为的刑法规制

The Discussion of Traditional Criminal Law Regulation of Internet Insulting Behaviors

进入网络时代以来,犯罪的“网络异化”使现行刑法与网络空间的裂痕不断扩大,犯罪构成要件要素普遍经历着异化过程,现行刑法与理论面临挑战。网络侮辱行为由于主体的流动性与规范因果关系的模糊性,面临规制障碍。在灵活运用刑法解释的基础上,应慎重认定网络侮辱发起者与积极参加者等侵害主体,对“暴力”与侮辱性质的理解应置身于网络语境中,通过考察初始行为、介入行为与结果三者的关系,建立实行行为与危害结果的实质关联。随着定量标准体系的不断演化,逐步建立契合网络侮辱犯罪特征的全面综合的定量标准体系,实现传统语境向网络语境的过渡。

Since we entered the Internet era,the gap between traditional criminal law and cyberspace is widening because of crime’s network alienation.The constitutive elements of crime are undergoing the process of alienation,traditional criminal law and theory are facing challenges.Because of the fluidity of subject and the ambiguity of normative causality,Internet insulting behaviors are not easy to be regulated.On the base of flexible application of criminal law interpretation,we should cautiously identify the network insult initiator and active participants,search for meaning of violence and insult in the context of Internet,establish the essential connection between the implementation behavior and the harmful result by examining the relationship between initial behavior,intervention behavior and outcome.With the continuous evolution of quantitative standard system,we should gradually establish comprehensive quantitative standard system which fits characteristics of internet insult crime,realize the transition from traditional context to network context.
