法治保障是实施军民融合发展战略的主要目标和手段之一,加快推进军民融合发展立法迫在眉睫,立法定位则是军民融合发展立法的前提。在法的分类视角下,军民融合发展的立法主要是军民融合发展的一般法和特别法的立法,其形式意义上的一般法的名称被十三届全国人大常务委员会正式确定为《中华人民共和国军民融合发展法》,体现了该法命名的合理性。军民融合发展法的性质是经济社会和军事等多部门法的交叉综合性法律,其具有协调法、促进法、保障法的功能,应当以此为基础建立起军民融合发展的统筹机制、协调机制、动力机制和保障机制。可以将军民融合发展法的基本原则确定为维护国家安全、强化国家主导、坚持市场运作、注重融合共享,其中,维护国家安全是底线,强化国家主导和坚持市场运作是军民融合发展互为补充的方式,注重融合共享是军民融合发展的手段,四个原则最终服务于军民融合发展的总目标。
