传统中医药是我国的民族文化瑰宝,随着国际交往的日益频繁,在得到海内外广泛认可的同时,也伴随着无休止的知识产权被侵害现象。日本汉方药发展迅速,势头良好,其在专利保护方面的“专利网”战略、“1.5次开发”仿制战略、“专利先行”战略、科技研发投入、专利成果转化等相关经验,不仅让我们看到了自身存在的问题,也为完善我国传统医药专利保护制度提供了有价值的参考。

Traditional Chinese Medicine(TCM)is a national cultural treasure of China.With the increasingly frequent international exchanges,it has been widely recognized all over the world,but also accompanied by endless infringement of intellectual property rights.Japanese Kampo medicine has developed rapidly,the“patent network”strategy,“1.5 development”generic strategy,“patent first”strategy,the investment of scientific research and achievements transformation,which not only made us aware of the existing problems,but also provided valuable reference for improving the patent protection system of TCM.
