摘要
韩东屏教授的文章《走出僵局:亲亲相隐是非善非恶的可容行为》凭借道德价值的四分框架,把亲亲相隐定性为非善非恶的欠当行为,提出了一个既不同于肯定派、也不同于否定派的新颖论点,并阐发了若干精辟的洞见。这些观点虽然具有独树一帜的原创特色,却自相矛盾,而且背离了现实生活,因而是一种有漏洞的理论虚构。其致命伤在于:将正当(守当和欠当)说成是非善非恶的价值无涉,结果无法解释它怎么能够成为人们评判不当恶行的底线标准。由此,其立论并未解决正当为何必要的关键问题,割裂了善与正当的内在关联,尤其忽视了亲亲相隐包含着“帮助亲人对抗社会公正”的不当因素,因而会造成某些逻辑上的自相矛盾,在总体上无法成立。
In his article“A Tolerable Action Irrelevant to Goodness or Evil:A Reevaluation of Kin Concealment”,Professor Han Dongping reevaluates kinship concealment as the sub-just activity irrelevant to good nor evil according to his own characteristic four-divided framework of moral values.In this way,he not only puts forward a new argument that is clearly different both from the ones of the proponents and the ones of the opponents,but also expounds some penetrating insights.Although these insights have their original characteristics,unfortunately,they will lead to some logical contradictions and deviate from real life,so they are a kind of theoretical fiction with loopholes.Their fatal defect lies in the point that they regard the right(including both the ordinary and the sub-just)as the value-free of non-good and non-evil,and thus cannot explain how it can become the bottom-line criterion for judging those wrong or evil acts.As a result,his argument could not be tenable in general because it fails to solve the critical issues of why the right or justice is necessary,separates the internal relationship between good and right,and especially ignores the wrongdoing or injustice of kinship concealment in“helping relatives against justice”.
