On Typification Thinking in Criminal Law Studies and Its Application to Teaching

摘要 刑法解释中概念思维模式存在因对概念理解机械而导致刑法适用僵化、难以拓展刑法用语的可能含义、无法应对疑难问题等瑕疵。刑法学教学应当摒弃纯粹的概念演绎,强化类型化思维的应用,其特质契合了刑法规范的属性,刑法规范是基于类实施的归纳,案例指导制度的发展为其提供了适用契机。应当培养受众规范理解刑法用语的含义、构建案件知识库、强化提炼裁判要旨的能力,形成理论指导实践,实践反哺理论,二者联动发展的良性循环格局。 Concept thinking model in interpretation of criminal law gives birth to rigid application of criminal law,difficulties in expanding the possible meaning of criminal law terms and failure to deal with difficult problems.Teaching of criminal law calls for abandoning of pure conceptual deduction,intensification the application of typification thinking,The peculiarity of criminal law conforms to the attribute of criminal law norm,which is based on sum-up of implementation of typification thinking.Development of case guidance system offers opportunity for application of typification thinking.Accordingly,efforts need to be made to train the audience's standardized understanding of the meaning of criminal law terms,construct case knowledge base,enhance the ability to extract the gist of a judgment and develop a positive cycle of practice-theory interactive development.
