TPP电子商务规则研究及其启示

Research on Electronic Commerce Rules in TPP and Its Enlightenment

作为一个“雄心勃勃的、21世纪的”TPP,其电子商务规则既有实体规定,也有确保义务履行的程序规定。总体来看,TPP电子商务规则是WTO和现有FTA的“升级版”,是现有电子商务规则的“集大成者”。虽前途未卜,但其代表了电子商务规则未来的发展方向。为此,我国应对TPP电子商务规则进行全面研究,客观的对待TPP电子商务规则,激活我国电子商务规则的内生动力,并争取电子商务规则的“制度性话语权”。

As an ambitious and 21st century TPP,the rules of electronic commerce include both substantive provisions and procedural provisions for ensuring the fulfillment of obligations.Taken together,electronic commerce rules of TPP are the“upgrade”of WTO and existing FTA,and are the aggregator of the existing electronic commerce rules.Although the future is uncertain,it represents the future development trend of electronic commerce rules.Therefore,China should conduct a comprehensive study of electronic commerce rules of TPP,treat the electronic commerce rules of TPP objectively,activate the endogenous power of China’s electronic commerce rules,and strive for the institutional discourse of electronic commerce rules.
