摘要
图书馆法规的调整手段分为规制和激励两类。围绕图书馆法规的激励手段形成了图书馆法规的激励制度。在分析激励、图书馆法规中激励的概念基础上,结合图书馆法规中含有“鼓励”的条文现状,析出权利、义务、责任、收益-成本配置层面、精神、惩罚、助力和阻力七种激励模式,通过对以权利为主要形式的用户权利义务规范配置的培育机制、其它激励模式的用户权利义务规范配置的选择机制、用户权利义务规范配置的激励性法律责任设定机制一系列的探讨,强化公共图书馆用户权利义务规范配置的激励机制的构建。
The adjustment means of library laws and regulations are divided into regulation and incentive.Around the incentive means of library laws and regulations,the incentive system of library laws and regulations has been formed.Based on the analysis of the concepts of incentive and incentive in library laws and regulations,combining with the current situation of the provisions of“encouragement”in library laws and regulations,seven incentive modes,such as rights,obligations,responsibilities,incom e-cost allocation level,spirit,punishment,assistance and resistance,are analyzed.Through the cultivation mechanism of standardized allocation of users’rights and obligations in the form of rights,other incentive modes are used.A series of discussions have been made on the selection mechanism of standardized allocation of users'rights and obligations,and the incentive legal liability setting mechanism of standardized allocation of users'rights and obligations,so as to strengthen the construction of the incentive mechanism of standardized allocation of users,rights and obligations in public libraries.
