摘要
近年来,未经许可使用影视剧截图引起的著作权侵权纠纷时有发生,虽然法院都认为应对截图提供保护,但所采路径截然不同。这一现状反映出学界缺乏对该问题的探讨研究,不利于统一司法实践。从侵权判定基本原理及国外案例来看,截图不应认定为影视作品的一部分;结合学界观点、电影产生历史以及我国法律规定来看,应将截图认定为独立的摄影作品,其原始著作权归属于摄像者,而不当然属于制片人。
In recent years,copyright infringement disputes caused by unauthorized use of screenshots of film and television dramas have occurred.Although the courts believe that the screenshots should be protected,the path taken is quite different.The current situation reflects the lack of research on the issue in the academic circle,which is not conducive to the unification of judicial practice.From the basic principles of infringement judgment,foreign cases,combined with the history of film production,and the legal provisions of China,the screenshots should be identified as independent photographs,and the copyright belongs to the photographer,not necessarily the producer.
