摘要
城市社区公共事物治理存在行政化的治理、市场化的治理和物权法治基础上的合作治理三种路径。随着住房制度改革的推进,城市社区的物权结构发生了根本性的变化,行政化的治理路径导致社区治理的政策和实践之间出现严重的错位。市场化治理路径下的社区治理实践难以有效地完成治理内容。在物权法治基础上推动政府治理和业主自治的良性互动,是破解“只有政府治理,不见居民自治”基层治理困境的基本出路。要坚持利益相关和成本收益对称两项基本原则,坚守“物权法治”的底线,按照社区公共事物分类的逻辑重塑社区居委会、服务站和业主组织之间的关系格局。
There are administrative path,market-oriented path and cooperative governance path based on the rule of law of property rights in the governance of urban neighborhood commons.With the implementation of housing system reform,the property structure of urban communities has undergone fundamental changes.The administrative path leads to serious dislocation between the policy and practice of community governance.In the market-oriented governance path,the practice can’t effectively fulfill governance purpose.Promoting the positive interaction between government governance and homeowner’s self-governance on the basis of rule of law in property is the basic way of going beyond the dilemma of“only government governance while no resident autonomy”in grass-roots governance.Specifically,we should persist on two basic principles,which are interest-related and cost-benefit symmetry and adhere to the bottom line of“rule of law in property”.We should also reinvent the relationships between residents’committees,service stations and homeowners’organizations according to the logic of classification of neighborhood commons.
