从现代教育治理看德治与法治的融合发展

On the Integrated Development of Moral Rule and Law Rule from the Perspective of Modern Educational Management

教育治理是推动教育现代化发展的关键举措,德治与法治是现代教育治理最重要的两个方面。由于德治与法治的治理范畴相互补充、治理标准梯队覆盖、治理力度软硬并重、治理时序全程覆盖,德法兼治模式在现代教育治理中具有可行性。现代教育治理过程中存在着社会化法治的有效性不足、人性化德治的关联性过度、多元化诉求的统一性不够等问题。在现代教育治理中促进德治和法治的融合,必须坚持双线并进、实践为基、矛盾发展的原则,加强德治规范化建设,强化法治人性化转变,构筑融合互动式渠道,营造常态融合氛围。

Educational management is the key measure of promoting the development of educational mod ernization,rule of virtue and rule of law are the two most important aspects of modern educational management.The pattern of applying virtue and law together is feasible in the modern educational management because the rule of virtue and the rule of law share the complementary categories of management,cover each other’s management standards,take the same soft and hard governance efforts,and cover the time and order of governance in the whole process.In the modern educational management exist a lot of problems such as the inefficiency of socialized rule of law,the hypercorrelation of humanistic rule of virtue,and the inadequacy of uniformity of multi-demands.To promote the integration of rule of virtue and rule of law in the modern educational management,it is necessary to stick to the principles of two parallel lines going forward together,practice being the basis,and contradictions being developing,to strengthen the construction of normalized rule of virtue,enhance the humanistic transformation of rule of law,construct the integrated interactive channel and create the normal atmosphere of integration.
