The Critical Value of Identity Law and Its Enlightenment to China’s Legal Construction

女权主义法学、种族批判法学、同性恋法学、亚太裔法学合称身份法学。身份法学属于20世纪后现代主义思潮的一部分,该法学流派的各支流派均突出人的身份特性,强调具体法制环境下个体的经历和感受,并以此认识法律及其运作过程。身份法学反对形而上的普遍性预设,否定传统自由主义法治理论;批判机会平等和普遍正义的观点,呼吁学界关注现代法律的身份伦理转向及其意义。身份法学对西方完美主义理性法治的批判,有助于我国司法实践中关注少数群体,兼顾形式正义和个体正义。

Feminist jurisprudence,ethnic critical jurisprudence,homosexual jurisprudence and Asian-Pacific jurisprudence are collectively called identity jurisprudence.Identity law belongs to a part of the postmodernism trend of thought in the 20th century.Each school of this law school emphasizes the identity characteristics of human beings,emphasizes individual experiences and feelings under the specific legal environment,and thus understands the law and its operation process.Identity law opposes metaphysical universal presupposition and denies traditional liberal theory of rule of law.Criticizing the viewpoint of equal opportunity and universal justice,the author appeals to the academic circle to pay attention to the identity ethics turn of modern law and its significance.Identity law is conducive to understanding the real legal operation process and has reference significance for China’s legal construction.The critique of the western perfectionist rational rule of law by identity law is helpful to pay attention to minority groups and give consideration to formal justice and individual justice in China’s judicial practice.
