Revolution,Law and Women: On the Principle of No-fault Divorce and the Liberation of Chinese Women in the 20th Century

无过错离婚原则源自婚姻自由的观念,在革命的不同阶段,该原则得到了不同程度的贯彻实施,1950年《婚姻法》最终确立了无过错离婚原则,为建立现代婚姻家庭关系扫清了障碍。无过错离婚原则的实施给妇女带来了人身和思想观念上的解放,而且解放的深度和广度是史无前例的。因此,无过错离婚原则是以法律的形式推动20世纪中国妇女解放,在这一过程中所积累的经验也是革命留给中国妇女宝贵的历史财富。

The principle of no-fault divorce derived from concept of marriage freedom and was implemented to various extents at different stages of revolution.It was finally established with the passage of the Marriage Law in 1950,thus clearing the way for modern marital and family relationship.The implementation of the nofault principle has liberated women physically and mentally to a depth and extension unprecedented in history.Therefore,the principle of no-fault divorce pushed forward Chinese women's liberation in the form of law in the 20th century,and the experience thus gained in the process of revolution is also an invaluable historical asset to Chinese women.
