Analysis and Suggestions of the Framework of Medical Institution Management Under the Background of Healthy China

从立法框架的角度出发,分析当前《医疗机构管理条例》立法框架的内在逻辑。根据文献检索、专家咨询方法,按照管理主体、管理对象、管理内容、管理手段,明确当前立法框架可能面临的主要问题,结合我国大陆地区各地方以及其他国家和地区医疗机构管理立法经验,提出立法框架修改建议,为后续医疗机构管理立法的修正提供参考。

From the perspective of the legislative framework,the paper analyzes the internal logic of the legislative framework of China’s current Medical Institution Management Regulations. According to the method of literature retrieval,expert consultation,in accordance with the management subject,management object,management content and management method,the the main problems which current legislative framework may face are explicated. Through combining with domestic local medical institutions as well as management legislation experience of other countries and areas, suggestions of the legislative framework amendment are put forward, in order to provide reference for the amendment of follow-up management legislation of the medical institutions.
