依法治考视阈下自考地方性立法的研究与实践——以天津市为例

Research and Practice on Local Legislation of Self-Taught Examination Under the Perspective of Governing Examinations by Law——Taking Tianjin as an Example

高等教育自学考试是我国社会主义高等教育体系的重要组成部分,是国家基本教育制度和考试制度。经过30多年的发展,自学考试制度对于促进教育公平和国民素质提升表现出了积极的作用,但相关法律法规建设却严重滞后,这制约了自学考试的健康发展。因此,在目前全面依法治国的背景下,健全自学考试法制体系刻不容缓。文章以国家教育考试的立法现状为切入点,结合新形势下自学考试面临的问题,分析了地方性立法的必要性,并对天津市自学考试地方性立法的相关研究和实践工作进行阐述,以期为其他省市自考办和上位法修订提供有益的借鉴。

Self-taught examination is an important part of our socialist higher education system,and it is also the national basic education system and examination system.After more than 30 years’development,the self-taught examination system has played a positive role in promoting educational equity and improving national quality.However,the construction of relevant laws and regulations is lagging behind,which restricts the healthy development of self-taught examination seriously.Hence,it is urgent to improve the legal system of self-taught examination,which is related to the background of ruling the country by law.Based on the current legislative situation of national education examination and the problems faced by self-taught examination under the new situation,this paper discusses the necessity of local legislation.Furthermore,the relevant research and practice of local legislation of self-taught examination in Tianjin are revealed as well in order to provide useful reference for other provinces and revision of the superior law.
