新《土地管理法》的进步与不足

The progress and shortcomings of the new Land Management Law

靳《土地管理法》体现了以人民为中心的人本理念、与时俱进的发展理念、维护公平正义的程序理念。确定了土地征收的公益目的性要件,完善了征收程序。明确了集体经营性建设用地入市的客体范围、集体经营性建设用地入市的一级市场和二级市场的方式和条件。应当将宅基地的“三权分置”政策上升为法律规范,多占和超占宅基地实行有偿使用,设置宅基地使用权收回及补偿规则,建殳宅基地有偿退出的具体规则。在统一和规范法律用语、强化法律规范之间的衔接方面,新《土地管理法》仍存在改进的空间。

The new version of Land Management Law embodies the humanistic idea of people-oriented,the development Idea of keeping up with the times,and the procedural idea of maintaining fairness and justice.It determines the public welfare purpose elements of land expropriation,improves the expropriation procedure,specifies the objective scope of that collective operating construction land enter into the market,and defines the ways and conditions that collective operating construction land enters into primary and the secondary markets.The policy of “separation of three rights”of homestead should be upgrade to legal norms,the over occupation of homestead be paid accordingly.Rules should be set up for the recovery and compensation of usage of homestead,and specific rules be established for the paid withdrawal of homestead.There is still room for improvement in the new law in terms of the unification and standardization of legal terminology and strengthening the conection between legal norms.
