Criticism and Justification on Legal Dogmatics of Constitution of Gang-rape

轮奸是强奸罪的加重犯罪构成,也是强奸罪的共同正犯类型。但是,对轮奸行为样态的解释不能只是根据加重犯罪构成和共同正犯的类型进行逻辑的推论。从不同的解释进路辨析可知,轮奸不要求有"二人以上强奸既遂"。从被害人的角度考察,应以"性私密性"和"亲密性"作为轮奸处罚的思想基础,轮奸是指二人以上基于轮奸的故意而轮流实施奸淫行为,不要求有人强奸既遂。当然,基于轮奸之故意而仅仅实施预备行为或者只是停留在手段行为阶段,以及其他没有"二人以上轮流奸淫"侵害事实出现的类型,不构成轮奸。

Gang-rape, an aggravating constitution of rape crime, is a type of co-principal of rape crime. However, we can’t simply interpret behavioral pattern of gang-rape and have logic inference just based on aggravating constitution and type co-principal. Judging from different interpretation methods, completed rape by two or more people is not a necessary condition for the constitution of gang-rape. From the angle of a victim, the privacy and intimacy of sex shall be the theoretical basis for punishing gang-rape, and the constitution of gang-rape only requires the fact that two or more people have implemented the act of rape instead of completed rape. In the event that there is merely preparatory behavior or suspension at the stage of means behavior out of the deliberate offence, and other types without the assault facts of rape by turn committed by two or more people, gang-rape is not constituted.
