Development along with the Legislation: The Study of Marriage and Family Law in the New China

为立法提供理论支持和对策建议是中国婚姻家庭法学研究的特色。从1950年《婚姻法》到1980年《婚姻法》,再到2001年婚姻法修正案,以及新近民法典婚姻家庭编撰,学界在婚姻家庭法与民法关系、夫妻财产制结构、裁判离婚标准三个议题上的学说演进与对策建议,对立法产生了积极影响。后民法典时代的婚姻家庭法学研究挑战与机遇共存。民法思维与研究范式的全面浸入是不可避免的趋势,与此同时,婚姻家庭法学研究应当对社会进步与发展进程中出现的新现象和问题做出积极回应。

To provide theoretical support and countermeasures for legislation is one of the features of the research on Chinese marriage and family law.Three issues have been paid much more attention to by Chinese academic circles since the Marriage Law of 1950,which are the relationship between marriage and family law and civil law,the structure of matrimonial property,and the standard of referee’s divorce.In the future,the challenges and opportunities on the studies will coexist.The comprehensive immersion of civil law thinking and research paradigms will be an inevitable trend.At the same time,the research on marriage and family law should respond positively to new phenomena and problems in the process of social progress and development.
