法治建设成效纳入政绩考核的问题及建议——一个激励理论的视角 被引量:5

摘要 党的十八届四中全会提出要把法治建设成效作为衡量各级领导班子和领导干部工作实绩的重要内容,纳入政绩考核指标体系。领导干部是我国法治建设中的关键少数,政绩考核的主要功能是对领导干部的激励。在激励理论的视角下,法治建设与传统政绩考核事项有重大差别,由于法治系统的复杂性、法治效果的难量性、法治建设的高资源需求性、法治建设考核的外部性、激励强度不合理等结构性缺陷,导致了对干部的激励扭曲现象。应当针对法治建设的特殊属性,实现激励手段的复合化、考核要素的均衡化、考核体系的开放化及考核机制的精细化,以强化法治建设政绩考核对干部的激励效果。 The Fourth Plenary Session of the 18 th CPC Central Committee proposed that the effectiveness of the rule of law construction should be included in the performance appraisal system as an important part of job performance of leading bodies and leading cadres. Leading cadres are a key minority in the construction of the rule of law in China. The key function of performance appraisal is the incentive for leading cadres. From the perspective of incentive theory, there is a significant difference between the rule of law construction and the traditional appraisal content, due to the complexity of the rule of law system, the measurement difficulties for of the rule of law effect, the high resource demand for the rule of law construction, the externality of the rule of law construction appraisal, the irrational incentive intensity, Structural defects have led to distortions in the incentives for cadres. In view of the special attributes of the rule of law construction, the combination of incentives, the equalization of appraisal factors, the openness of the appraisal system and the refinement of the appraisal mechanism should be implemented to strengthen the incentive effect of the rule of law construction performance appraisal on cadres.
