企业劳动争议调解:从“存废之争”走向“合理发展” 被引量:1

摘要 企业调解是中国特色劳动争议调解制度的重要组成部分,是企业履行社会责任、有效运行企业冲突管理系统以及促进企业劳动关系氛围的需要。合理发展企业劳动争议调解,需要运用全面发展观理解企业调解组织的存在意义,延伸企业调解组织工作职能链,提高其认知度和公信力,建立企业调解经费制度及购买公共服务,增强企业调解的专业性和独立性,制定企业、仲裁和法院三方定期沟通制度,节约社会调解资源,提升企业调解效力,真正发挥基层劳动争议调解组织的源头治理作用。 Enterprise mediation is an important part of the labor dispute mediation system with Chinese characteristics and it is the need for enterprises to fulfill their social responsibilities,effectively run the enterprise conflict management system,and promote the construction of enterprise labor relationship atmosphere.Reasonable development of the enterprise labor dispute mediation is necessary to build the opinion of comprehensive development in order to understand the significance of existence in the mediation organization,extension of enterprise mediation organization function chain to improve their awareness and credibility,building enterprise settlement funds and purchasing social public service system to enhance specialization and independence of enterprise mediation,making tripartite regular communication system with the enterprise,arbitration and court to save social mediation resources to promote enterprises’mediation quality,playing the role of the source of labor dispute mediation organizations at the grass-roots level management.
