黑社会性质组织犯罪的新特征及社会化治理路径探析

New Characteristics and Ways of Socialized Governance in Gangland Organization Crimes

随着中国特色社会主义进入新时代,为了满足人民群众对美好生活的向往和追求,党和国家更加重视对作为社会毒瘤的黑恶势力犯罪的有效治理,新一轮扫黑除恶专项斗争的开展不仅必要而且适时。在黑恶势力中,黑社会性质组织由于自身具有较高的组织性,而且往往对某一特定地区形成强力控制,因而对当地人民生活的安宁稳定与社会秩序的破坏更为严重,需要法律予以更多的关注,做到“打早打小”与“打准打实”相结合、“宽严有据”与“罚当其罪”相结合。从犯罪治理的角度看,作为时刻处在变化状态的社会现象,当前黑社会性质组织犯罪在组织特征、经济特征、行为特征和非法控制特征四个方面均呈现出新的发展态势,需要依托政党、国家和社会公众的协调配合,共同构建起对该类犯罪的社会化综合治理体系,以彻底铲除黑社会性质组织赖以生存的土壤。

As socialism with Chinese characteristics entering a new era,in order to meet the people's yearning for and pursuit of a better life,the Party and state pay more attention to effectively crack down on the gangland organization crimes,which is also called social cancer.A new round of special action,"clean up the black and wipe out evil",is not only necessary but also timely.Featuring highly organized and strong control,gangland organization,as one of the evil forces,posed greater threaten on peace and stability of local people's lives and social order.Therefore,it requires laws combine“early and small”with“accurate and solid”,“leniency and severity according evidences”with“deserved punishment”.From the perspective of crime control,gangland is an ever-changing social phenomenon,and its current nature presents a new expanding trend in four aspects,namely,organization,economy,behavior as well as illegal control.All this needs to rely on the cooperation of political parties,the state and the public to build a socialized comprehensive governance system so as to completely eradicate the soil on which the gangland organizations depend for their survival.
