法律职业共同体的“离散”困境与“聚合”路径

“Discrete” of Legal Professional Community Dilemma and “Aggregation” Path

法律职业共同体应当呈现出一种"聚合"状态。但目前在我国法律职业共同体建设中仍存在:共同体成员构成问题上未形成统一认识、共同体成员之间相互缺乏认同感、共同体内部的流动呈现单向性、职业伦理的要求具有较大差异等"离散"问题。上述问题产生的缘由在于:在中国传统文化层面,不同法律职业存在历史鸿沟;在现实制度层面,不同规范之间缺乏有机的整合统一;在实践运行层面,不同群体存在一定的利益博弈。未来,应通过强化教育,提升对法律职业共同体的认同感;夯实制度,统一和整合现行的相关规范;深化改革,勇于自我革命和改革创新等路径,增强我国法律职业共同体的聚合性。

The legal professional community should present a state of "aggregation". However, there are still some "discrete" problems in the construction of the legal professional community in China, such as the lack of a unified understanding of the composition of the members of the community, the lack of mutual identity among the members of the community, the unidirectional flow within the community, and the great differences in the requirements of professional ethics. The reasons for the above problems are as follows: at the level of traditional Chinese culture, there is a historical gap between different legal professions;at the level of practical system, there is a lack of organic integration and unity between different norms;and at the level of practical operation, there is a certain interest game among different groups. In the future, we should enhance the cohesion of our legal professional community by strengthening education, enhancing the recognition of the legal professional community, consolidating the system, unifying and integrating the relevant norms within the community, deepening reform, daring self-revolution and reform and innovation.
