摘要
行政约谈是具有协商性的行政执法行为,旨在通过执法机关与违法相对人之间的协商交流,达成理解,促使相对人自觉改正。学界关注于行政约谈与既有行政行为的相似性,缺乏对行政约谈的独特内涵与具体程序的探究。行政约谈作为一项独立的行政行为,以行政相对人违法违规为前提,以促使相对人自己改正为目的。行政约谈的面谈过程中,正式性与非正式性程序并存,协商性与非协商性内容交融。行政约谈的独特性质使得行政约谈有别于其他行政行为。行政约谈具有提高行政效率、降低执法矛盾的优势,但是当前行政约谈实践中存在以约谈代替处罚、协商程度低等问题,只有构建具体约谈行为规则,才能充分发挥行政约谈的优势,推动国家治理现代化。
Administrative interviews are negotiated administrative law enforcement actions aiming at achieving understanding and exchange between law enforcement agencies and illegal counterparts,and prompting relative parties to consciously correct.The academic community pays attention to the similarity between administrative interviews and existing administrative behaviors,and lacks the exploration of connotation and specific procedures.As an independent administrative act,the administrative interview is premised on the violation of laws and regulations by the administrative counterparts,so as to promote the relative parties to correct themselves.In the process of interviews in administrative interviews,formal and informal procedures coexist,and consultative and non-negotiating content blends.The unique nature of administrative interviews makes administrative interviews different from other administrative acts.Administrative interviews have the advantage of improving administrative efficiency and reducing contradictions in law enforcement.However,in the current practice of administrative interviews,there are problems such as replacing interviews with interviews and low consultation levels.Only by constructing specific rules of interviews can the advantages of administrative interviews be fully realized.
