摘要
文章分析了当前国有土地出让方式的利与弊,并结合集体土地自身的特点,明确了在集体土地各种出让方式适用中对出让主体规制、出让平台建设等方面的特殊要求;通过比较分析各试点地区的政策规定及实际出让情况,认为各出让方式适用范围不清是目前最大的问题。建议:(1)保障农民权利,制约出让主体权力;(2)统一城乡建设用地交易平台,实现利益主体分离;(3)参照国有土地出让方式,明确集体土地出让方式适用范围及程序。
This paper analyzes the advantages and disadvantages of the current transfer methods of state-owned land. According to the characteristics of collective land, the paper clarifies the special requirements in the application of various transfer methods of the right of using collective construction land, including the regulation of the land transfer subject, the construction of the land transfer platform, etc. Through contrastive analysis of the policy provisions and actual transfer situation in the pilot areas, the paper considers that the current biggest problem is that the scope of application of each land transfer methods is not clear. Suggestions are as follows:(1) Protecting peasants’ rights and restricting the power of the land transfer;(2) Unifying the transaction platform of all construction land and implementing the separation of stakeholder;(3) Defining the scope and procedure of transfer methods of the right of collective construction land with reference to the state-owned land transfer methods.
