中国共产党党内法规解释制度建设研究——以法律解释经验为借鉴

On the Perfection of the Interpretation System of Inner-party Laws and Regulations Based on the Experience of Legal Interpretation

党内法规解释是构建党内法规体系的重要组成部分,是适用党内法规必不可少的步骤。但从目前的各种规定来看,党内法规的解释并没有构成自己的体系,有关其制定主体的规定比较混乱,解释程序和解释的技巧方法也没有形成严格的规定,严重影响了党内法规解释的权威性。解释方法和程序不足且缺乏必要的限制,无法完全适应党内法规解释的需要。而我国的法律解释制度在很大程度上克服了这些问题,对党内法规解释制度的完善有着积极的借鉴意义。借鉴法律解释制度的优势,从解释主体、解释技巧方法、解释程序等方面对党内法规解释制度进行必要的完善和改进,从而提高党内法规解释的科学性、合理性和权威性。

The interpretation of inner-party laws and regulations is an important part of the construction of inner-party laws and regulations system,and an essential step to apply inner-party laws and regulations.However,an analysis of the current provisions finds many problems in it.The interpretation of the party’s laws and regulations does not constitute its own system,and the provisions on the main body of its formulation are confusing and lack of necessary feasibility at the central level.The interpretation procedures and interpretation techniques and methods do not form strict provisions,even lack the necessary rationality in the procedures,seriously affecting the authority of the interpretation of the party’s laws and regulations.The insufficiency in the interpretation methods and procedures and the lack of necessary restrictions can not fully meet the needs of the interpretation of inner-party laws and regulations.Luckily,the legal interpretation system of our country has overcome these problems to a great extent,which can serve as a positive reference for the improvement of the interpretation system of inner-party laws and regulations.In order to improve the scientificity,rationality and authority of the interpretation of inner-party laws and regulations,it is necessary to perfect and improve the interpretation system of inner-party laws and regulations from the aspects of subject,skills and methods and procedures of interpretation.
