摘要
劳动契约关系立法需要兼顾实现社会公平与社会经济效益的双重协调。劳动契约关系规范如何在人工智能技术时代下实现其价值目标,其前提在于将劳动契约关系本身置于何种理论框架之下进行阐释。关系契约理论采用法社会学的分析视角,重新构建起契约理论的法理基础,以“关系”为契约的核心要素,利用社会学分析方法在法哲学层面形塑了现代契约理论全新的人文价值和经济学价值目标。现代劳动契约关系的内在产生基础与关系契约理论的主张是一致的,关系契约理论为现代劳动契约关系的理论与现实困境提供了更加科学、开放的解释框架及体系。
The labor contract relationship needs to take into account the dual functions of achieving social equity and social economic benefits.Fairness and efficiency are two aspects of the standard value of labor relations.How the labor contract relationship norm achieves its value goal in the era of artificial intelligence technology,the premise is to explain the labor contract relationship itself under what theoretical framework.The theory of modern contract law is the result of the contract theory produced by the third industrial revolution and the wave of social reform.It is represented by Professor McNeil’s relational contract theory,paying attention to the independent value of the relationship elements in the process of social division of labor and exchange.This study applies sociological analysis method to shape the new humanistic value and economic value target of modern contract theory at the level of legal philosophy.The intrinsic basis of the modern labor contract relationship is consistent with the relational contract theory.The relational contract theory provides a more compatible interpretation framework and system for solving the theoretical and practical dilemmas of the modern labor contract relationship.
