性侵害未成年人违法犯罪人员从业禁止机制研究

Study on the Mechanism of Prohibition of Employment for Criminal Personnel of Sexual Assault of Minors

当前未成年人遭受性侵害的案件时有发生,应加强对性侵害违法犯罪人员进行惩治管控以防止再犯罪,预防和保护未成年人不受侵害。从检察机关办案过程及其相关工作领域角度,研究分析我国性侵害违法犯罪人员从业禁止的实践探索情况和存在的主要问题,提出要从明确从业禁止的期限和适用主体、职业禁止范围,建立涉性侵违法犯罪人员信息库等方面构建和完善性侵害违法犯罪人员从业禁止机制。

At present,cases of sexual assault of minors occur from time to time,and it is necessary to strengthen the punishment and control of sexual assault offenders to prevent further crimes and prevent and protect minors from infringement.From the perspective of the handling of cases by procuratorial organs and their related fields of work,we have studied and analyzed the practice and exploration of the prohibition of sexual assault and criminal offenders in China and the main problems that exist,and put forward the need to clarify the period of prohibition and the scope of application of the prohibition.We will establish a database of information on sex offenders and improve the mechanism for prohibiting the employment of sex offenders.
