村民请求查询复制村委会账簿的权利在行使中受到阻碍。村委会账簿查询复制制度虽因账簿记账混乱、管理不当及村民权利滥用的防范问题而未建立,但这些都不是该制度不设立的理由。现有法律规定为该制度设计提供法律基础,而村民在村委会的财产权、委托代理理论与村民的社员权则为制度设立提供了法理基础。村委会账簿查询复制制度应当明确。
