民主嵌入司法:《人民陪审员法》的价值向度

Democracy Embedding Judicature: The Value Orientation of the People’s Jury Law

《人民陪审员法》的核心在于回归司法民主,通过民主嵌入重构人民司法,提升司法公信。《人民陪审员法》所嵌入的民主内涵包含了三个相互关联的基本向度:一是数量民主向度,这一向度在于解决谁有资格做人民陪审员的问题,其核心是陪审员的准入资格;二是容量民主向度,这一向度在于解决陪审员参审机会问题,其核心是陪审权利的保障与实现;三是质量民主向度,这一向度在于解决陪审员在司法审判中发挥的作用问题。《人民陪审员法》的有效贯彻与实施应当从准确把握民主的三个向度入手,而评估《人民陪审员法》的实施成效及将来如何进一步完善人民陪审员制度也应以此为依凭。

The core of the People’s Jury Law is to return to judicial democracy,embed justice through democracy,and reconstruct people’s justice and improve judicial public trust. The democratic connotation embedded in the People’s Jury Law contains three interrelated basic dimensions: first is the quantitative dimension of democracy. This dimension is to solve the problem of who is qualified to be a people’s juror.The core is the qualification of the juror;second is the capacity dimension of democracy,to solve the problem of jury members’ participation in the trial. The core is the guarantee and realization of jury rights;third is the quality dimension of democracy,to solve the role of jurors in judicial trials. The effective implementation of the People’s Jury Law should start with accurately grasping the three dimensions of democracy. The evaluation of the effectiveness of People’s Jury Law and how to further improve people’s jury system should also be based on this.
