The 70-Year Development History of the Rule of Law in China’s Higher Education

我国高等教育立法在建国后曲折起步,改革开放后伴随法治理念的确立而快速发展,至今已形成初步的法律规范体系并在依法治国背景下加快建设高等教育法治体系。高等教育法治为我国高等教育事业的健康发展提供了规范依据和重要保障,未来应继续深化法治理念,完善高等教育法律体系和制度,强化教育行政执法,重视司法在高等教育法治中的功能。

The legislation of higher education has experienced a process of a zigzag start after the founding of New China, a repaid development with the establishment of rule of law concept since the Reform and Opening up, a formation of a preliminary rule of law system until now and an accelerating construction of the rule of law system in higher education under the background of law-based governance of the country. The rule of law in higher education provides a normative basis and important guarantee for the healthy development of China’s higher education. In the future, the concept of rule of law should continue to be deepened;the legal system of higher education law should be improved;the educational administrative law enforcement should be strengthened;attention should be paid to the function of judicature in the rule of law in higher education.
