《民法典人格权编(草案)》创造性地完成了人格权正面确权,符合人格权发展的最新趋势。人格权的正面确权既有其历史必然性,也存在坚实的概念基础,但也面临客体理论上的难题,亟待学界检讨、更新。人格权独立成编的体系意义在于,既顺应了民法调整对象的理论发展,夯实了民法上人格·财产的二元结构,也体现了确定权利边界的立法要求,彰显了中国民法典编纂的时代特色,但人格权编还应进一步明晰人格、财产关系和具体人格权边界,并发掘人格权在信息、科技下的新样态。民法典人格权编应遵循一般规定、自然人人格权、特殊财产权的体系布局。

The Personality Rights Part(Draft) of Chinese Civil Code creatively completes the positive confirmation of personality rights, which conforms to the latest trend of the development of personality rights. The positive confirmation of personality right has not only its historical inevitability, but also a solid conceptual foundation. It faces the difficult problems on the object of rights, which needs academic circles to update the theory of the object of rights. The systematic significance of the independent compilation of personality rights in Chinese Civil Code lies in that it not only conforms to the theoretical development of object of civil law, but also embodies the dual structure of personality and property in civil law, reflects the legislative requirements of determining the boundary of rights, and highlights the characteristics of the times of the codification of Chinese Civil Code. However, the legislation of personality rights should further and explore the new pattern of personality rights under the background of information and technology. The systematic layout of Personality Rights Part should follow the order of general provisions, natural persons’ personality rights and special property rights.
