城市房屋使用性质变更立法完善建议 被引量:1

摘要 在城市化快速推进、大众创业与营商环境优化、民众降低创业成本等多种因素的影响下,变更房屋使用性质的情况日益普遍。不适当的变更会给社区安宁、建筑物安全、环境保护以及治安交通等带来消极影响,亟待相关立法加以完善。我国现行法在城市房屋使用性质变更的要件、程序以及法律后果等方面尚存缺漏,应结合多地相关实践经验,综合已有法律规定,在《城市房地产管理法》中确立城市房屋使用性质不变为原则变为例外、变更审批为原则备案为例外的理念,明确城市房屋使用性质变更应当具备的要件以及禁止的情形,规定审批程序以及永久变更和临时变更的法律责任。 Under the mix of several factors such as advancement of urbanization, massentrepreneurship,business environment optimization,and reduction of business cost,it is increasingly common to change the housing usage nowadays.Many improper changes adversely affect the community harmony,building safety,environmental protection, and public security and traffic,and related legislation is urgently required to improve such changes.Existing laws do not cover all the aspects on elements,procedures and legal consequences about the change of urban housing usage.Many local governments have accumulated favorable practical experience about these aspects.Therefore,we shall,with the integration of Property Law and other regulations,establish the concept inUrban Real Estate Management Law that the housing use property shall not be changed in principle but changed in exception and that the change should be approved in principle but filed in exception,identify the necessary conditions and prohibits on the change of urban housing use property, and specify the approval procedure and legal consequences of permanent and temporary changes based on Property Law and other laws.
