司法实践中检察监督是规制虚假诉讼的有力途径。检察监督原则上针对审判权和执行权,特定情形中应当对当事人、其他诉讼参与人以及相关案外人实施监督。检察机关对某些非讼程序中的虚假行为应当扩大对虚假裁定的监督,加强依职权发现虚假诉讼的能力:对于案外人的控告、举报,应当降低形式审查,不要求其必须提交相关裁判文书及证据材料。虚假诉讼的检察监督,在调查核实中要从结案方式、案由类型、查阅卷宗、核实有关信息、对审判人员的调查等方面展开。

Procuratorial supervision is a powerful way to regulate false litigations in judicial practice.The procuratorial supervision should be directed at the judicial power and executive power in principle,yet in specific circumstances,it can also be directed at the plaintiffs and complainants,other litigation participants and related outsiders.The procuratorial organs should expand their supervision over false orders or decisions given in certain non-litigation procedures and strengthen their capability to discover false lawsuits according to their fimctions and powers.For the complaints and reports submitted by the non-litigants,they should lower the threshold for form examination and do not require the provision of relevant acljudication documents and evidence materials.In the process of the procuratorial supervision over false litigations,the investigation and verification should focus on tlie way of closing the case,the type of the cause of the case,consulting the files,verifying the relevant information and investigating the judges.
