摘要
2019年5月美国加州北区地方法院在FTC诉高通公司垄断案一审判决中认定高通公司垄断成立。十六万多字的判决详尽地阐述了法院如何认定高通公司在标准必要专利许可与芯片销售领域的做法排除竞争并构成垄断。涉及法律问题覆盖专利权用尽、搭售、拒绝交易、专利计费单元等,是标准必要专利反垄断司法的重大推进。案件发生在全球贸易摩擦频繁发生的历史背景下,判决的未来走向将反映美国在国家利益、政治考量与法律事实发生激烈冲突时的选择。该案暴露的法律与政策问题将督促我国的知识产权政策尽快在制定、执法与司法方面从跟随者向引领者转变。
In May 2019,the first instance trial of the US District Court for Northern District of California held that Qualcomm monopoly established.The 160,000-word ruling details how the court found that Qualcomm’s practices in the areas of standard essential patents licensing and chip sales preclude competition and constitute monopoly.The legal issues cover the exhaustion of patent right,tying arrangements,refusal to deal,the smallest salable patent-practicing unit,etc.This case represents a major advance of antitrust judicial mechanism concerning standard essential patents.The case occurred against the backdrop of frequent global trade friction.The tendency reflected by the judgement may indicate the US choice when national interests,political considerations and legal facts tangle together.The legal and policy problems exposed in the case make it necessary for China to change from IP policy taker to leader as soon as possible.
