论监察委员会与检察院职能的衔接

On the Connection Between the Functions of Supervisory Committee and Procuratorate

《监察法》的出台及《刑事诉讼法》的相应修改,明确了监察委员会的监察权限、监察范围、监察程序,界分了监察委员会与检察院的监督对象与职权。在此基础上,监察委员会与检察院的职能衔接,实际上就成了监察调查与检察审查起诉的程序衔接,重点包括案件的移送与对接、证据的转化与使用、留置与强制措施的衔接、补充调查与补充侦查的协调等衔接内容。不过,因为当前法律规定相对概括,缺乏具体的操作规程,为实现监、检机关职能的高效顺畅衔接,依法构建沟通协商机制、规范协调案件的移送与接收、完善检察机关证据审查机制等衔接机制有其切实的必要性。

The issue of inspection act and corresponding amendments to the criminal procedure law has been clear about the supervisory committee’s supervisory authority,supervisory scope,procedures,and object boundary points of the supervision of the supervisory committee and the people’s procuratorate and authority on this basis,the functions of the supervisory committee and the people’s procuratorate connection,actually became a supervisory investigation and procuratorial work of examination and prosecution procedure connection,mainly including the case of transfer and docking,evidence of the transformation and use,lien and compulsory measures in the street,supplementary investigation and the coordination of supplementary investigation content cohesion,however,because the current law relative to sum up,the lack of specific operational procedures,In order to realize the efficient and smooth connection between the functions of the procuratorial organs,it is necessary to establish a communication and consultation mechanism according to law,standardize and coordinate the transfer and reception of cases,and improve the procuratorial organs’evidence review mechanism.
