From Speculative Reason to Practice: Marx’s Criticism of Hegel’s Thought of Legal Philosophy

黑格尔的法哲学具有明显的思辨理性的特征,他没有脱离其逻辑学的研究进路。马克思在《黑格尔法哲学批判》中批判了黑格尔法哲学思想,他认为黑格尔的法哲学无论是方法还是内容都脱离了现实世界及其本体论——实践,马克思在批判黑格尔思辨理性的法哲学的过程中也实现了哲学本体论的转向,这种转向通过批判路径和批判内容两个方面表现出来。

Hegel’s philosophy of law has obvious characteristics of speculative reason,for he did not deviate from the research approach of his logic.In The Criticism of Hegel’s Philosophy of Law,Marx criticized the idea of Hegel’s philosophy of law.He believed that Hegel’s philosophy of law was separated from the real world and its ontology---practice whether in method or in content.Marx also realized the change of direction of the ontology of philosophy in the process of criticizing Hegel’s philosophy of law on speculative reason.Such a change of direction is embodied in the aspects of critical path and critical content.
