浅谈大数据环境下公民个人信息的法律保护

Discussion on Protecting Citizens’ Personal Information in the Context of Big Data

随着经济和社会的迅猛发展,人类社会已经进入大数据时代。我们享受着大数据时代带来的快捷便利的同时,也面临着个人信息的危机与风险以及隐私权泄露的可能,海量数据的分析和利用,必然会导致公民个人隐私受到威胁。对大数据利用的管控力度不够,可能会引起大数据被滥用的危险。针对《中华人民共和国刑法》现状、刑法谦抑性被遗忘、“公民个人信息保护法”尚未出台等问题,需要明确相关概念,细化量刑标准,禁止处罚过度扩张,保持刑法谦抑性,改革立法模式,完善法律体系,并出台“公民个人信息保护法”。

With the rapid development of economy and society,human society has entered the era of big data completely.Whenever we enjoy the fast and convenient information transmission brought by the era of big data,we are also faced with the crisis and risks of personal information and the possibility of privacy disclosure.The analysis and utilization of massive data will inevitably pose threats to citizens’personal privacy.If the control over the use of big data is inadequate,it will lead to the risk of its abuse.In the era of big data,it is a must to define personal information clearly and recognize that citizens are faced with personal information crisis.Due to the status quo of China’s criminal law,and the fact that restrain principle of criminal law has been forgotten and relevant laws of the personal information protection law have not been enacted,great efforts shall be made to clarify relevant concepts,refine sentencing standards,prohibit excessive expansion of punishment,and stick to the restrain principle of criminal law.Efforts shall also be made to reform the legislative model,improve the criminal law system,and enact the law on the protection of personal information.
