法治视野下人民警察角色定位研究

Research on Role Orientation of People’s Police in View of Rule of Law

警察角色是法治社会下法律赋予警察的权力和责任,角色的定位不能仅从打击犯罪和服务社会入手,应综合考量警察的本质属性和执法环境。我国警察角色的定位存在较多现实矛盾和冲突,但现阶段我国警察角色定位仍应当以社会秩序的管理者为主,兼具服务群众和打击犯罪等职能。从法律修改来看,完善警察角色的定位可以从立法和执法等方面入手,指导规范警务改革和警察体系建设,维护社会稳定。

The role of the police entails the power and responsibility given to the police by the law in a society ruled by law.Therefore,its role orientation should not only start with cracking down on crimes and serving the society,but also comprehensively consider the essential attributes and law enforcement environment of the police.There are many practical contradictions and conflicts in the orientation of the police role in our country,but at this stage,the orientation of the police role in our country should still focus on social order management,serving the people and cracking down on crimes.Judging from the revision of the law,improving the orientation of the police role can start from the aspects of legislation and law enforcement,guide and standardize the police reform and the construction of the police system,and maintain social stability.
