摘要
《民法典继承编草案》的规定存在一些不足,应当加以改进和完善。删除调整对象、继承权男女平等、夫妻再婚遗产处理的规定等重复性和无实质意义的规定。修正放弃继承、继承权丧失、代位继承、遗嘱形式、遗产债务清偿、无人继承又无受遗赠的遗产之处理等存在缺陷的规定。增设继承回复请求权、遗产共有的形态、遗产分割的效力等必备继承规则。
There are some deficiencies in the provisions of the Draft of Succession Chapter of Civil Code,which should be further improved.This paper propose the following approaches.Delete such repetitive and meaningless provisions as the object of adjustment,the equality of inheritance rights between men and women,and the disposal of estates from remarriage.Amend such defective provisions as abandonment of inheritance,loss of inheritance right,subrogation inheritance,form of will,clearance of inheritance debt and disposal of estates without successor or legacy-support agreement.Add some rules of necessity,such as the right of request for restitution of inheritance,the form of joint estates and the effectiveness of the division of estates.
