性侵未成年人刑事案件高发类型及预防机制实证研究——以北京市某区人民检察院案件办理为样本

Empirical Research on Types and Prevention Mechanism of Sexual Assault on Minors——Taking the Cases Handled by Certain District People’s Procuratorate in Beijing as Samples

未成年人作为身心尚不成熟的弱势群体,容易成为刑事犯罪的对象。近年来,性侵未成年人的刑事案件屡屡见诸于媒体,引起舆论的巨大关注与讨论。分析性侵未成年人刑事案件的特点,建立有效的性侵未成年人案件预防机制,降低性侵未成年人犯罪数量成为司法理论和实务界研究的重要课题。本文以北京市某区为例,对检察机关近三年办理的性侵未成年人刑事案件进行统计,梳理出四类高发案件类型,分别对每类案件的特点和反映出的问题进行分析,并提出对建立性侵未成年人犯罪预防机制的建议。

As the physically and mentally immature vulnerable groups,minors are easy to become the object of criminal offenses.In recent years,the criminal cases of sexual assault on minors frequently appear in media,causing wide concern and discussion of public opinion.Analyzing the characteristics of sexual assaults on minors,establishing an effective prevention mechanism,and reducing the frequency of sexual assaults has become an important subject in the field of judicial theory and practice.Taking a certain district in Beijing as an example,this paper conducts statistical analysis on the criminal cases of sexual assault on minors handled by the procuratorial organs in the past three years,sorts out four types of high-incidence cases,analyzes the characteristics and reflected problems of each type of cases,and put forward suggestions on establishing the prevention mechanism of sexual assault on minors.
