摘要
近年来,我国常常出现合同债权转让的法律风险与经济纠纷。我国之前的法律对于合同债权转让等问题存在不适应性,因此在新合同法中,承认原有合同法律制度存在的不足,保证了在新合同法中债权问题不会给经济市场的稳定造成混乱。针对新合同法中债权转让存在的法律风险,通过分析并提出相应的防范措施,希望为解决我国合同债权转让问题提供新的思路。
In recent years,legal risks and economic disputes over the contract credit assignment often appear in China.The previous law are not suitable for the problem of contract credit assignment.Therefore,the deficiencies of the original contract legal system are recognized in the new Contract Law,and it guaranteed the credit problem will not cause confusion to the economic market.Aiming at the legal risks of the credit assignment in the new Contract Law,this article analyzed and proposed corresponding preventive measures to provide new ideas for solving the problem in China.
