From Value to Regulation: Study on Choosing Regulation Approach about Obligee Abusing the Notice of “Takedown”

网络通信技术和信息传播技术的不断更新为电子商务的发展提供了坚实的基础。与此同时,电子商务平台上的知识产权侵权行为也日益严重,严重制约了电子商务的健康发展。《电子商务法》第42条有力回应了近年来电子商务领域畸生且泛滥的知识产权侵权恶意投诉现象。该条款在虽然在一定程度上对权利人滥用“通知-删除”的行为进行了规制,但仍然面临着诸如合格通知构成要件不明确、平台主动义务界限不明、通知处理时效不清晰等问题。因此,结合“通知-删除”的价值功能看,应构建完善的通知审查机制,细化电商平台的义务和法律责任,再配合以技术手段,建立担保救济机制、投诉分层机制和网页冻结的利益矫正机制,以期能构建起有规制作用的“通知-删除”规则,从而促进电子商务的健康持续发展。

The continuous update of network and information communication technology lays a solid foundation for the development of e-commerce.At the same time,the infringement of intellectual property rights on the e-commerce platform become more and more serious,which severely restricts the healthy development of e-commerce.Article 42 of E-commerce Law has strong response to the abnormal and rampant hostility complaints of intellectual property infringement in the field of e-commerce in recent years.Although the article regulates the abuse of"notice-takedown"by the obligee to some extent,we still have problems such as unclear elements of qualified notice,unclear boundaries of active obligations of the platform and unclear time limit for notice handling.Therefore,combined with the value function of"notice-takedown",we should build a perfect notice review mechanism,refine the obligations and legal responsibilities of e-commerce platform,and then establish a guarantee relief mechanism combing with technical means,complaint stratification mechanism and interest correction mechanism of webpage freezing with the purpose of building a regulatory"notice-takedown"rule,so as to promote the healthy and sustainable development of e-commerce.
