在整个社会文化转型背景下展开的文化强国建设面临着多元文化冲突、主流文化认同危机与经济建设发展不平衡等诸多问题。宪法的文化转型功能及其实现不仅是引导和促进社会文化转型的重要方式,也是建设文化强国的重要路径,其实质就是重构社会文化秩序,通过宪法使转型社会文化规范体系化、多元文化观念有序化。宪法文化转型功能的双重实现机制主要包括静态规范层面和动态实施层面。我国宪法文化转型功能主要通过对中国特色社会主义文化的明确,对国家文化职能、文化制度的确立以及对公民文化权利的保障来实现。

In the context of social and cultural transformation,the construction of powerful cultural country is confronted with many problems,such as multicultural conflict,mainstream cultural identity crisis,and imbalanced economic development.Constitutional cultural transformation function and its realization are not only an important way to guide and promote the transformation of social culture,but also an important path to construct a powerful cultural country.The essence of this is to reconstruct social and cultural order,and to make the transformation of social and cultural norms and multicultural concepts through the constitution ordered.The realization of constitutional cultural transformation includes the dual realization mechanism of static constitutional norm and the dynamic constitutional implementation.Overall,the cultural transformation function of our constitution is mainly realized through the clarification of socialist culture with Chinese characteristics,the establishment of national cultural function and cultural system,as well as the guarantee of citizens’cultural rights.
