论日本人对南沙群岛海南渔民和地理景观的记述——兼论南海仲裁案对某些史实的不确之说 被引量:6

摘要 南海仲裁案中,仲裁庭在“关于南沙群岛高潮地物的事实认定”部分,引用大量日本文献,讲述这些岛屿的植被、商业活动等情况,意欲说明南沙主要岛屿不适合“人类居住”。剖析相关文献,还原南沙群岛的历史场景,可发现仲裁庭在对日本文献的解读、运用存在着明显错误,其结论自然也荒谬。日本人对南沙群岛资源的盗采是侵犯中国主权的行为。众多劳工在岛活动达8年之久的事实也说明这些群岛具有适合人居的自然属性。仲裁庭对南沙主权争议采取回避态度,对关键的历史事实把握失准,其“裁决”无益于南海问题的根本解决。 In the South China Sea Arbitration,the Arbitral Tribunal cited a large number of Japanese archives in the section of“Factual Findings Concerning High-Tide Features in Nansha Islands”,describing the vegetation and commercial operations of these islands,in order to show that the main islands of Nansha Islands were not suitable for“human habitation”.By analyzing the relevant archives and restoring the historical scenes of Nansha Islands,it is not difficult to find that the Arbitral Tribunal had obvious errors in the interpretation and application of the Japanese archives,so it was inevitable to draw absurd conclusions.The Japanese had violated China’s sovereignty by stealing resources from Nansha Islands.The fact that so many workers had been on the island for eight years also shows that these islands have natural characteristics suitable for human settlements.The Arbitral Tribunal took an evasive attitude toward the disputes over Nansha sovereignty and misunderstood the key historical facts.Its adjudication was not conducive to the fundamental settlement of the South China Sea issue.
