论南沙岛礁建设的环境保护

Environmental Protection of Construction on Nansha Islands and Reefs

菲律宾在2013年单方面提起了南海南仲裁案,在七项诉求中环保诉求涉及海洋环境保护和海洋生态体系等,指控中国岛礁建设以及不合理的渔业活动破坏了南海海洋环境。针对指控中关于南沙岛礁建设的污染,我们在分析《联合国海洋法公约》相关条款内容、南沙岛礁工程建设的过程控制以及岛礁的环保整治措施等基础上,驳斥菲方的无理之说。同时,中国也在南沙岛礁环保方面有新进展,建设生态保护修复相关设施,正式启用中国科学院岛礁综合研究中心,不断摸索创建海洋环保的南海模式。中国有义务法维护南海海洋环境,应适时发布环境影响评价报告,鼓励公众参与,推进《海洋基本法》的立法,完善《岛礁保护法》等专门性立法,在加强环保宣传开展生态修复工作的同时,积极寻求南海国际环境合作,以期从低敏感领域解决南海争端。

In 2013,the Philippines unilaterally filed a“South China Sea Arbitration”.In seven appeals,environmental protection claims include marine environmental protection and marine ecosystems which make Western attention on the pollution of the South China Sea focus on the construction of China’s islands and reefs and unreasonable fishing activities.In response to the complaints about the pollution of the construction of the Nansha Island reef,on the basis of analyzing the contents of the relevant United Nations Convention on the Law of the Sea,the process control of the construction of the Nansha Island reef project,and the environmental remediation measures of the island reef,China refuted Philippine unreasonable remarks.At the same time,China has also made new progress in the environmental protection of Nansha islands and reefs,built related ecological protection and restoration facilities,officially launched the Chinese Academy of Sciences’Island Reef Comprehensive Research Center,and constantly explores the creation of South China Sea model of a marine environmental protection.China is obliged to maintain the marine environment in the South China Sea,timely release the environmental impact assessment reports,encourage the public participation,promote the legislation of the Basic Law of the Sea,and improve the specialized legislation such as the Law on the Protection of Islands and Reefs.While strengthening the dissemination of environmental protection and carrying out ecological restoration work,we should actively seek international environmental cooperation in the South China Sea in order to resolve disputes from low-sensitivity areas.
