专利开放许可的制度价值及其运行前瞻

The System Value of Patent Open License and Its Operation Prospect

2019年我国《专利法修》第四次修改草案稿引入了专利开放许可制度,该制度设计可有效应对目前随着专利授权量逐年增加,但科技成果转化率仍然较低,专利实施运用不足的现状,推动专利权经济价值的实现。但制度创建之初相关规定尚不完备,数据平台建设以及激励公开制度等尚未纳入,考察英国、法国、德国专利开放许可制度的相关内容,我国应当建立专利开放许可公共数据库,增设专利年费优惠等制度,系统构建专利开放许可制度,激励更多专利权人参与开放许可,促进专利技术实施运用。

In 2019,The fourth draft amendment to China's Patent Law introduced the patent open licensing system.The system design can effectively cope with the current situation of increasing the number of patent grants,but the conversion rate of scientifi c and technological achievements is still low,and the implementation of patents is insuffi cient.The realization of the economic value of patent rights.However,the relevant provisions at the beginning of the establishment of the system are still not perfect.The data platform construction and the incentive publicity system have not been included.To examine the relevant contents of the UK,France and Germany patent open licensing system,China should establish a public database of patent open licenses and add patent annual fee preferential system.The system system will establish a patent open licensing system,encourage more patentees to participate in the open license,and promote the implementation of patent technology.
