美好生活的法理观照:一个方法论上的追问

The Legal View of Good Life: An Investigation Based on Methodology

人民美好生活在主体上指向每一个人的美好生活。美好生活与法律制度的价值关联的纽结在于"幸福",人民的幸福就是最高的法律。人民美好生活命题在场域上强调法律不能脱离生活世界,法律要以服务于人的生活为出发点,并回归人的生活。法律对待美好生活的方式存在需要和实践两个维度。在需要的维度上,需要是价值判断的主观根据,人民生活需要被作为立法目的,作为法理基础为法律提供正当化证成。在实践方面,每一个人都可以追求一种按照自己的本性而自由生活的方式,法律的规范从纷繁复杂的具体生活实践中抽象出模式化的行为方式,来统摄丰富的生活世界。在方法论的意义上,法理思维回应人民美好生活的方式是:超越单一的、线性的、链条式的因果考量,在宏观上对法律关联事实进行总体性地把握;超越法律规范文本的界限,通过法的价值的思考,使得法律成为人的生活终极目的和意义的必要部分。在"美好"的价值面向上,法理思维有助于实现良法善治的价值关怀;在"生活"的事实面向上,法理思维有助于实现生活世界的事实关涉。

The people’s need to live a better life,pointing to the needs of everyone’s good life in the main body.The relationship between the good life and the value of the legal system through the keyword"happiness"is realized,the happiness of the people is the highest law.The people’s better life needs to be emphasized in the field that the law should return to the world of life,the law should be based on a better life with the capability to be implemented into the daily life.Need is the subjective basis of value judgment,people’s life needs to be used as a legislative purpose in many legal departments,as a legal basis for the law to provide a legitimate certificate.From the perspective of methodology,the way that the new pattern of legal thinking responds to people’s needs for a better life is to go beyond a single,linear,chain-based causal methodology,which aim to grasp the facts of legal association in general;to transcend the boundaries of legal normative texts;to reconsider the value of law;Ultimately,make the law a necessary part of as the purpose and meaning of human life.On the value orientation of"good",the new pattern of legal thinking is helpful to realize the value of good law and good governance,and the fact that the new pattern of legal thinking contributes to the realization of the world of life is concerned when the fact of"life"is oriented.
