摘要
2019年8月26日全国人大常委会通过《土地管理法》《城市房地产管理法》修正案。在有关土地征收改革方面,修正案的内容主要集中在缩小征地范围、规范征收程序、完善土地征收多元保障机制等方面。在征地范围方面,修改内容针对的主要是经营性建设用集体土地的征收。从修改情况看,虽然两法在经营性建设用集体土地征收范围方面作了一定的限缩性规定,但经营性土地征收改革总体上没有实质性突破,城镇规划区内经营性建设用地"先征收、再出让"的供用地模式总体上没有被打破。改革经营性土地征收,建立以公共利益为基础的土地征收制度,我国还有很长的路要走。
On August 26,2019,the Standing Committee of the National People’s Congress passed the amendments to the Land Administration Law of the People’s Republic of China and the Law of the People’s Republic of China on the Administration of Urban Real Estate.In terms of land expropriation reform,the amendments mainly focus on narrowing the scope of land expropriation,standardizing the land expropriation procedures,and improving the multi-security mechanism for land expropriation.In terms of the scope of land expropriation,the revised content mainly involves the collective land for business-related construction.According to the amendments,although the two laws have imposed certain restrictions on the expropriation scope of collective land for business-related construction,there is no overall substantial breakthrough in the reform of businessrelated land expropriation.The land supply and use model of"expropriation first,transfer later"for business-related land in urban planning area has not been changed in general.China has a long way to go in the reform of business-related land expropriation and the establishment of a land expropriation system based on public interest.
