The Construction of the Party Regulations in the New Era: Objectives, Problems and Paths

基于规范主义法学和法社会学的不同研究角度,理论界对党内法规制度属性的认识出现差异。党内法规作为一类重要的治理规范,其建设必须以良法善治为目标。当前,党内法规建设存在着规范性仍需提高,实效性有所不足,部分党内法规与国家法律衔接协调仍需加强等问题。加强党内法规制度建设,需要以习近平依规治党思想为指导,使党内法规建设同人民群众美好生活需要相契合,服务于党的建设的实践需要。同时,推动党内法规由义务性规范向义务与权利平衡性规范转变,加强党内法规与国家法律的衔接协调。

Based on the different research perspectives of normative law and sociology of law,there are differences in the theoretical circles′understanding of the attributes of Party regulations.As a kind of important governance norms,the construction of Party regulations must take good laws and good governance as the goal.At present,there are still some problems in the construction of the Party Regulations,such as the standardization still needing to be improved,the incomplete protection of the rights of Party members,the insufficient response of the Party Regulations to the needs of the people for a better life in some areas,and the need to strengthen the cohesion and coordination with national laws.To strengthen the construction of Party Regulations,we need to take Xi Jinping′s thought of ruling the Party according to the rule as guidance,so as to fit in with the needs of people′s beautiful life and serve the practical needs of Party building.At the same time,we should promote the transformation of the Party Regulations from the obligatory norms to the balanced norms of rights and obligations,and strengthen the cohesion and coordination between the Party Regulations and national laws.
