摘要
地方立法包含一种制度实践的含义,在法制统一的框架下,政治话语、法律规范常常陷入"区分后的封闭"以及"开放后的分歧"。如果将行政指令和立法规范视为互为体用的共同体,将目光转向立法规范上,那么是否存在可以共享的逻辑,立法共同体是否具备反思理性的可能,地方立法的反思理性面向的又是什么。文章借助卢曼、图依布纳、沃尔德伦、拉宾等学者在反思理性上的理路,尝试建构在立法理论上反思理性的解读框架,通过对G省《优化营商环境条例》的分析探索反思理性的实践面向。
Local legislation contains the meaning of a system practice. Under the framework of legal system, political discourse and legal norms often fall into "closure after distinction"and "disclosure after opening."If administrative instructions and legislative norms are regarded as a community and pay their attention to legislative norms, is there a logic that can be shared, is it possible for the legislative community to reflect rationality, and what are the aspects of local legislation? This paper attempts to construct a framework for rethinking rationality in legislative theory in the light of the theories of Luhmann, Turbner, Waldron and Rabin. Through the analysis of G Province’s Regulations on Optimizing the Business Environment, the practical orientation of reflective rationality is explored.
